Terms of Service

You must be at least 18 years old to use Fazool. By using the Service you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Service under applicable law.
• You have never been convicted of a felony, a sex crime, or any crime involving violence.
• You are not required to register as a sex offender with any government entity.

Fazool reserves the right to verify your eligibility at any time. Providing false information about your age or identity is grounds for immediate termination of your account.

To use Fazool you must create an account using email and password, Google sign-in, or phone number verification (SMS OTP). You agree to provide accurate, current, and complete information and to update it as necessary. If you sign up with a phone number, it cannot be changed after verification. You may add an email address and password to your account at any time. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@fazool.org if you suspect unauthorized access. Fazool is not liable for any loss arising from unauthorized use of your account.

You may not create more than one account. Accounts are non-transferable. We reserve the right to terminate duplicate accounts.

Fazool requires users to verify their identity by submitting a government-issued photo ID ("ID Verification"). Verification is required before accessing the discovery feed. You agree that:

• The ID you submit is genuine and belongs to you.
• You will not submit altered, forged, or another person's ID.
• Submitted ID images may be reviewed by human moderators and processed using automated tools to extract and verify name, date of birth, and ID number.
• Extracted data is stored in hashed or encrypted form and is not sold to third parties.

"User Content" means any photos, text, audio, video, or other material you upload or transmit through the Service. You retain ownership of your User Content, but you grant Fazool a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, and irrevocable license to use, copy, reproduce, process, adapt, modify, create derivative works from, publish, transmit, display, and distribute your User Content in any media or distribution method now known or later developed, for the purpose of operating, promoting, and improving the Service. This license is subject to your rights under applicable data protection law (for example, the GDPR right to erasure). This license survives account deletion for content that has already been shared with other users or incorporated into the Service, except where applicable data protection law requires deletion.

By submitting User Content you represent and warrant that:

• You own or have the necessary rights to the content.
• The content does not infringe any third-party intellectual property or privacy rights.
• The content complies with these Terms and all applicable laws.
• Photos depict only you and are recent, accurate likenesses.

All User Content is subject to review. We may remove content that violates these Terms without prior notice. Photos are reviewed before being shown to other users.

You agree not to, and will not assist others to:

• Create a fake profile or misrepresent your identity, age, or intentions.
• Use the Service for commercial purposes, advertising, or solicitation without our consent.
• Harass, bully, stalk, intimidate, threaten, or harm any other user.
• Post or transmit nudity, sexually explicit content, hate speech, or content that promotes violence.
• Solicit money from other users or engage in scam behavior.
• Share another user's personal information without their consent ("doxxing").
• Use the Service while operating a vehicle or in any manner that creates a safety risk.
• Attempt to gain unauthorized access to accounts, systems, or networks.
• Use automated scripts, bots, or crawlers to access the Service.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service in any way that violates applicable local, state, national, or international law or regulation.

Violations may result in immediate account suspension or termination, and may be reported to law enforcement.

We care deeply about safety, but we are not responsible for the conduct of users on or off the Service. You acknowledge and agree that your interactions with other users are entirely at your own risk. Fazool is not a party to any meeting, relationship, or communication between users. While Fazool performs identity verification on a best-efforts basis, we do not conduct criminal background checks, verify user intentions, or guarantee the accuracy or completeness of user profiles or the information users provide.

Fazool provides an optional Wali (chaperone) feature that allows users to invite a trusted family member or guardian to monitor their profile and conversations in accordance with Islamic principles.

• You may invite up to 3 Wali accounts at any time. Wali invitations are subject to the active chaperone limit enforced by the Service.
• Wali accounts have read-only access only. They may view your profile, approved photos, match inbox, and message history. They cannot send messages, swipe, or take any action on your behalf.
• Wali accounts are subject to the same community standards and Prohibited Conduct rules set out in Section 5 of these Terms. Misuse of Wali access (e.g., sharing screenshots, harassing the user's matches) may result in termination of the Wali account.
• Invite links expire after 1 hour. You may resend an invite to generate a new link.
• Both you (the user) and your Wali must comply with all applicable sections of these Terms. You are responsible for ensuring that any Wali you invite understands and agrees to abide by these Terms.
• Wali accounts are automatically removed when you remove them via Settings or when you delete your own account.
• Notice to all users: by using the messaging features of the Service, you acknowledge that the person you are communicating with may have an active Wali who can view that conversation. Wali accounts may not share, distribute, screenshot, or otherwise disclose the content of any conversation they access. Violations may result in immediate termination of the Wali account and, where applicable, legal action.

Fazool offers free and paid subscription tiers. Paid features are available through a recurring subscription. By subscribing you agree:

• Subscription fees are billed in advance on a recurring basis (monthly or annually).
• Your subscription renews automatically unless cancelled before the renewal date.
• To cancel, use the in-app settings, your Apple App Store account, your Google Play account, or contact support@fazool.org.
• All subscription fees are non-refundable, except where required by applicable law. Apple and Google in-app purchases are subject to their respective refund policies. Fazool may, in its sole discretion, offer refunds or credits on a case-by-case basis, but is not obligated to do so.
• We may change subscription prices at any time. We will provide reasonable notice of price changes through the Service. Continued use after a price change takes effect constitutes acceptance of the new price.
• Any virtual items, boosts, or consumable credits purchased through the Service are non-refundable under all circumstances.
• Initiating a chargeback or payment dispute against Fazool for a legitimate charge may result in immediate cancellation of your subscription.

Free trials (where offered) will convert to a paid subscription at the end of the trial period unless cancelled before the trial ends. You will not be charged during the trial period.

Fazool and its licensors own all right, title, and interest in the Service, including all software, design, text, graphics, logos, and trademarks. Nothing in these Terms grants you any right to use Fazool's trademarks, logos, domain names, or other distinctive brand features. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You agree to defend, indemnify, and hold harmless Fazool and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including any content you submit or any interactions you have with other users.

Informal resolution first

Before initiating arbitration, you agree to first attempt to resolve any dispute informally by contacting us at legal@fazool.org with a written description of the dispute, including your name, account email, and the relief you seek. Both parties agree to negotiate in good faith for at least 60 days from the date of that notice. If the dispute is not resolved within 60 days, either party may proceed to arbitration. Compliance with this informal resolution process is a condition precedent to initiating arbitration.

Binding arbitration

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the county where you reside or via telephone or video conference. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

In accordance with the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (9 U.S.C. 401 et seq.), claims alleging sexual assault or sexual harassment are exempt from mandatory arbitration. A claimant alleging such conduct may elect to bring those claims in court rather than in arbitration.

EU, EEA, UK, and Swiss users

If you reside in the European Economic Area, United Kingdom, or Switzerland, the mandatory arbitration and class action waiver provisions of this section do not apply to you. You may bring claims in the courts of your country of residence in accordance with applicable local law. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Opt-out

You have 30 days from the date these Terms become effective to opt out of arbitration by sending written notice to arbitration-opt-out@fazool.org. If you opt out, all disputes will be resolved in the courts of Travis County, Texas.

These Terms and any disputes arising under them shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration agreement above, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

You may delete your account at any time through the app settings. Fazool may suspend or terminate your account and access to the Service at any time, in its sole discretion, with or without cause, with or without notice, and with no obligation to provide a reason. This includes, but is not limited to, violation of these Terms, suspected fraud, initiating a chargeback or payment dispute for a legitimate charge, or conduct on or off the Service that we deem harmful to other users, the Service, or Fazool. Upon termination, your right to use the Service ceases immediately. You will not be entitled to any refund of subscription fees upon termination.

Your rights under these Terms are personal to you and are not assignable or transferable. In the event of your death, your account will be terminated and your data handled in accordance with our Privacy Policy and applicable law.

The following sections survive termination of these Terms or your account: User Content, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution and Arbitration, Governing Law, and this Termination section.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we may, at our discretion, provide additional notice through the Service (such as a banner or pop-up). Your continued use of the Service after the updated Terms are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Fazool regarding the Service and supersede all prior agreements, representations, and understandings.

Fazool shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, denial of service attacks, failures of third-party infrastructure providers (including cloud hosting, payment processors, and authentication providers), or any other event that could not have been reasonably foreseen or prevented. During any such event, Fazool's obligations under these Terms are suspended for the duration of the event.

The failure of Fazool to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Fazool.

You may not assign or transfer these Terms or any rights or obligations hereunder without Fazool's prior written consent. Fazool may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets, without restriction or notification.
